All UNET, Inc., subscribers should carefully
read and understand the
following terms and conditions before signing.
Universal Joint Network Technologies, Inc. (UNET) is an Internet
Service Provider (ISP) established in 1996 primarily to address
the needs of small and medium-sized businesses for Internet
access. UNET has a clear channel International Private Line (IPL)
direct to the US Internet backbone which is readily available 24
hours a day, 7 days a week. We also keep a back-up link via
Taiwan for additional redundancy.
DEFINITION OF TERMS
1. The following words shall have these meanings in the
Agreement unless otherwise specified:
“Universal Joint Network Technologies, Inc. or UNET, Inc.” –
Internet Service Provider.
“Services” – Various services provided by UNET, Inc. that
includes Dial-up and Leased line Internet connectivity, Web
Development, Web Hosting, Email Systems, Internet Computing and
VPN Solutions and other service offerings offered by UNET, Inc.
from time to time.
“Subscriber” – Any individual, group, agency or institution
which has expressed interest in availing of UNET’s Services.
MODE AND TERMS OF PAYMENT
2. The subscriber must pay in cash or check the full amount
of the sign-up fee equivalent to one month of billing
corresponding to the type of service that he wants to avail of
upon signing this Agreement. Payment is due within five (5) days
of the statement date. However, accounts are in default if
payment is not received within five (5) days after the date of
invoice in that case, Service may be interrupted without prior
notice. All payments must be made in favor of UNIVERSAL JOINT
NETWORK TECHNOLOGIES, INC. with:
Savings Account # 096-3-01168384-3
Metropolitan Bank and Trust Company
Ayala Branch, Makati City
3. The client shall pay his dues directly to UNET, Inc. or by
depositing the amount to the accredited bank of UNET, Inc. The
accomplished subscription form together with the validated
deposit slip indicating the subscriber’s name, account number
and purpose should be sent thru FAX immediately or not later
than five-thirty (5:30 P.M.) in the afternoon in order for the
payment to be credited into the Subscriber’s account. New
accounts with late payments will be activated on the following
day.
4. Any complaints regarding billing statement must be filed
within seven (7) days upon receipt of the Statement of Account
or it shall be considered acceptable to the Subscriber. 5. UNET,
Inc. shall provide the Subscriber thirty (30) days advance
written notice in case of an increase in base rates of Services.
The subscriber will then be given ten (10) days from the
effective date of increase to answer in writing a request for
termination of service. Otherwise, the Subscriber’s existing
connection of Service will be billed at the new base rates.
6. Accounts with two (2) months outstanding balance shall
receive notice of disconnection thru E-mail. Failure to make
necessary payment despite repeated notices, UNET Inc. may, at
its sole discretion, either suspend or disconnect the Service
and shall require the Subscriber of an applicable reconnection
fee.
7. Subscriber shall notify UNET, Inc. any upgrading or
downgrading of subscription plan and temporary suspension of
Service with a written request sent thru Fax or E-mail at
billing@unet.net.ph in which the said request shall take effect
on the succeeding month.
8. Subscriber is responsible to notify UNET, Inc. in writing for
the disconnection of Service account whether permanent or
temporary. Failure to comply shall be liable to the payment of
monthly charges.
9. UNET, Inc. will provide Subscribers with monthly Statement of
Account and Sales Invoice via postal mail. Payment must be made
fully for the invoiced amount.
EXTRA CHARGES ON USAGE
10. The client shall be billed for the number of hours or a
fraction thereof in excess of the free usage hours. The free
usage hours that are not consumed in a month shall be forfeited
and therefore shall not in any case be carried over to the
succeeding month.
VALUE ADDED TAX (VAT) AND OTHER CHARGES
11. Subscriber must pay the government-mandated value-added
tax equivalent to ten percent (10%) of the total cost of all the
Services provided. The Subscriber shall also be responsible and
liable for any and all charges made using the said Subscriber’s
unique log-in name or through various log-in passwords provided
for the use of the Subscriber.
SUPPORT AND MONITORING
12. Technical support will be provided under the specified
restrictions. Technical support will be provided to support
standard products related to Internet connectivity. Requests for
support for other functions, products or services are not
included in the standard connection fee.
13. The Services are provided “as is” without warranty of any
kind and it is not possible to make any guarantees about
bandwidth and response time on the Internet due to the
Internet’s cooperative and distributive nature.
14. The right to use the Services are non-transferable. UNET,
Inc. reserves the right to refuse/disconnect service to anyone
at anytime for any reason. Service may automatically be
terminated if Subscriber fails to comply with the terms and
conditions of this Agreement, or in the event of termination of
the service agreement with UNET, Inc.
15. UNET, Inc. will not be responsible for any damage client
suffers from the use of the Internet. This includes loss of data
resulting from delays, non-deliveries, misdeliveries, Service
interruptions, Subscriber’s errors or omissions, or due to
inadvertent release or disclosure of information sent by client.
Use of any information obtained via the Internet is at
Subscriber’s own risk. UNET, Inc. specifically denies any
responsibility for the accuracy or quality of information
through its services.
16. The use of Internet to transmit certain kinds of information
(including without limitation, computer software and other
technical data) may violate export control laws and regulations
of the Philippines, whether that information is received abroad
or by foreign nationals within the Philippines. Since UNET, Inc.
exercises no control whatsoever over the content of information
passing through the Internet, the entire burden of complying
with such laws and regulations rests with its clients.
Subscriber agrees to comply with such laws and regulations and
to indemnify and hold UNET, Inc. harmless from any damages
Subscriber may suffer resulting from any violation of the export
control laws of the Philippines.
17. The terms and conditions mentioned above supersede all
previous presentations, understandings, or agreements. Use of
UNET, Inc.’s services constitutes acceptance of these Terms and
Conditions. UNET, Inc. may modify these terms and conditions, as
modified.
